Terms of website use

Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.

In addition acceptance of delivery of the goods shall be deemed conclusive evidence of the buyer’s acceptance of these conditions.

Acceptance of general terms and sales conditions

Any variation of these terms and conditions (including any special terms and conditions agreed between the two parties) shall be inapplicable unless agreed in writing by Camélia Unipessoal Lda.

Unless specifically stipulated and with a written agreement between the parties, all orders are subject to these general terms and sales conditions, which supersede other documents such as brochures, press articles, catalogues, or e-mails issued by the seller and which may only have an indicative value.

Offers / Prices / Orders

All our tea offers are subject to availability. Prices are indicated in Euros (VAT included). Our offers are available for private customers only. The delivery of the order will be undertaken once full payment of the agreed price has been confirmed to have been received into our bank account.

Means and conditions of payment

Payment of the goods is entirely due upon placement of order, either by Paypal, ATM Payment, or bank transfer to the following account at:

Invoicing

An invoice indicating the price in Euros and including VAT will be issued by Camélia Unipessoal, Lda. and mailed to the customer’s invoicing address. Delivery to one address in mainland Portugal is free for orders of 80 Euros (VAT included) or more. For orders of less than 80 Euros or for orders outside mainland Portugal a delivery charge will be made. The delivery charges are displayed when ordering online.

Deliveries

All the goods are insured by our company during their transport and are carried at our own risk. Deliveries to mainland Portugal are normally made within 4 business days (6 business days outside mainland Portugal) and are from the date of reception of payment of the goods at our office. However, these periods are indicative only and may vary according to availability of stock or other issues outside the control of Camélia Unipessoal, Lda. In addition Camélia Unipessoal, Lda. will not be liable to the buyer in anyway for late delivery or short delivery of the goods.

However, if 10 days have elapsed after the above 4 or 6 day period and the goods have not yet been delivered, the customer can cancel the order. The customer will then obtain a refund of their payment apart from all other compensation or damages, within at most, 14 days. In any event, delivery within the indicated period can only occur if the client has provided the seller with accurate delivery details. In case of such an error, Camelia Unipessoal, Lda. will not be held responsible for the failure to deliver the goods at the address specified or within the above timescales.

Upon reception of the goods, it is up to the addressee to check the state of the goods and to note any issues regarding breakage, damage or missing goods on the delivery slip and to inform Camélia Unipessoal, Lda. in writing within 48 hours.  If this occurs and there is no further stock available, the customer will be asked if they will accept an equivalent replacement product.

Cancellations

The customer has a period of 14 days from the receipt of their order to request a cancellation of the order and request a refund.

The customer must inform Camélia Unipessoal, Lda. in writing of their intention to cancel. Once the cancellation request is received, a further period of 14 days is given to the client to return the unwanted products for exchange or refund. The returned goods must be in their original packaging, unopened and in mint condition. The cost of the shipment to the customer will not be refunded. Camélia Unipessoal, Lda. reserves the right to defer a refund until all goods are delivered back to our office for confirmation. If the customer wishes a refund then they will have to pay the costs of returning the product.

Property reserve

It is to be expressively understood that ALL OUR GOODS REMAIN OUR PROPERTY, WHEREVER THEY MAY BE, UNTIL THE COMPLETE SETTLEMENT OF THE CORRESPONDING INVOICES. This is not an obstacle to the transfer of the risks to the buyer, once the delivery of the goods is effective.

Applicable law and jurisdiction

These general conditions of sale are subject to the application of the Portuguese law.

Visuals and data protection

Photos and illustrations displayed on the website are non-contractual. The rights of all information displayed thereon (texts, images, logos, graphics, icons) remain the property of their owner and are registered and protected by copyright laws.
